Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") form a binding agreement between you and Haven Travel ("Haven," "we," "us," "our"). By creating an account, creating a trip, joining a trip as a guest, or otherwise using Haven, you agree to these Terms and our Privacy Policy. If you do not agree, do not use Haven.

2. Description of Service

Haven is a group travel coordination platform. Hosts create trips, manage rooms and schedules, and coordinate with guests. Guests view trip details, select rooms, and communicate with the group. Haven is a coordination tool only — we are not a party to any lodging, travel, or purchase arrangement between a host and their guests, and we do not book, sell, insure, or guarantee any travel product.

3. Eligibility & Accounts

You must be at least 18 years old to create a Haven account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at help@haventravel.app of any unauthorized use.

4. Host Responsibilities

Hosts are solely responsible for the accuracy of trip details, room information, house rules, and any pricing or cost information they provide to guests. Hosts are responsible for having the legal right to use, book, or grant access to any property, listing, or accommodation associated with a trip they create in Haven.

5. Payments & Plans

Certain features are offered on paid plans and unlocked through our third-party payment partner. Haven does not store your full payment card details. Peer-to-peer payment collection between hosts and guests (e.g., via linked payment handles) happens directly between those users on third-party platforms; Haven does not process, hold, or guarantee those funds and is not responsible for disputes between hosts and guests regarding payment amounts, refunds, or non-payment. All purchases of Haven plans are final and non-refundable except where required by law or by the applicable app store's refund policy.

6. Acceptable Use

You agree not to: post false, misleading, or fraudulent information; harass, threaten, or abuse other users; upload malicious code; scrape or reverse-engineer Haven; attempt to circumvent plan limits, paywalls, or platform features; or use Haven for any unlawful purpose. We may suspend or terminate accounts that violate this section.

7. User Content & Intellectual Property

Haven, its design, logos, and underlying software are owned by Haven Travel and protected by copyright and other intellectual property laws. You may not copy, redistribute, or create derivative works from the platform itself.

"User Content" means anything you upload or submit to Haven — including cover photos, property photos, room photos, messages, group plan entries, concierge links, and reviews. You retain ownership of your User Content. By submitting User Content, you grant Haven a limited, non-exclusive, royalty-free, worldwide license to host, store, display, and transmit that content solely to operate and provide the Haven service to you and the guests on your trip.

You represent and warrant that you own or have all necessary rights and permissions to submit your User Content, and that it does not infringe any third party's copyright, trademark, privacy, publicity, or other rights. You are solely responsible for your User Content. Do not upload images, text, or other material you found online, screenshotted, or copied unless you own it or have a license that permits this use — copyright infringement carries real legal exposure (U.S. law allows statutory damages up to $150,000 per work for willful infringement), and Haven will remove infringing content and may terminate repeat infringers under Section 8 below.

8. Copyright Policy & DMCA Notice

Haven respects the intellectual property rights of others and expects users to do the same. We respond to notices of alleged copyright infringement that comply with the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512.

Filing a takedown notice. If you believe content on Haven infringes your copyright, send a written notice to our designated DMCA agent that includes: (1) your physical or electronic signature; (2) identification of the copyrighted work claimed to be infringed; (3) identification of the material you claim is infringing and its location on Haven; (4) your contact information (address, phone, email); (5) a statement that you have a good-faith belief the use is not authorized; and (6) a statement, under penalty of perjury, that the notice is accurate and that you are authorized to act on the copyright owner's behalf.

Counter-notification. If you believe your content was removed in error, you may submit a counter-notice with: your signature, identification of the removed material and its prior location, a statement under penalty of perjury that you have a good-faith belief the removal was a mistake, and your consent to the jurisdiction of the federal court in your district (or, if outside the U.S., any district in which Haven may be found).

Repeat infringer policy. Haven will terminate, in appropriate circumstances, the accounts of users who are repeat infringers.

9. Disclaimer of Warranties

Haven is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee uptime, error-free operation, or the accuracy of any host- or guest-submitted content, including trip details, pricing, house information, or third-party listing data imported into Haven.

10. Limitation of Liability

To the fullest extent permitted by law, Haven and its owner will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from your use of Haven — including disputes between hosts and guests, travel cancellations, property or booking issues, or payment disagreements. Haven's total aggregate liability for any claim arising from these Terms or your use of Haven will not exceed the greater of (a) the amount you paid Haven in the 12 months before the claim, or (b) $100.

11. Indemnification

You agree to indemnify, defend, and hold harmless Haven Travel and its owner from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from: (a) your User Content, (b) your violation of these Terms, (c) your violation of any third party's rights (including copyright), or (d) any dispute between you and another user (host or guest) arising from a trip.

12. Termination

We reserve the right to suspend or terminate accounts that violate these Terms, at our discretion, with or without notice. You may delete your account at any time from within the app.

13. Dispute Resolution — Binding Arbitration & Class Action Waiver

Please read this section carefully — it affects your legal rights. You and Haven agree that any dispute, claim, or controversy arising out of or relating to these Terms or your use of Haven will be resolved by binding individual arbitration under the Consumer Arbitration Rules of the American Arbitration Association (AAA), rather than in court, except that either party may bring an individual claim in small claims court if it qualifies.

Class action waiver. You and Haven each agree to bring claims only in an individual capacity, not as a plaintiff or class member in any purported class, consolidated, or representative proceeding. The arbitrator may not consolidate more than one person's claims.

Opt-out. You may opt out of this arbitration agreement by emailing help@haventravel.app with the subject "Arbitration Opt-Out" within 30 days of first accepting these Terms, including your name and the email associated with your account.

If this arbitration agreement is found unenforceable as to a particular claim or dispute, that claim or dispute will be resolved in the state or federal courts located in California, and both parties consent to personal jurisdiction there.

14. Governing Law

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws principles, except to the extent superseded by the Federal Arbitration Act as described in Section 13.

15. Severability & Entire Agreement

If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Haven regarding your use of the service.
